When the MIT members, in course of their duties, conduct crimes
or when crimes derive from their duties and criminal prosecution
is required, permission has to be obtained from a superior authority
instead of directly starting the criminal prosecution procedure
by the police, the judges and the attorneys. This is a matter of
confidence that is necessary for the efficient conduct of intelligence
activities concerning the continuity of the State. The related 28th
Article stipulates the following: "When the MIT members, in
course of their duties, have to undergo criminal prosecution due
to crimes that have derived from the nature of their duty or have
occurred during the conduct of their duty, permission must be obtained
from the Prime Minister."
